Booking Information & Conditions of Chartering
(Please Read Carefully)
Thank you for your for enquiry. We would like you to
have an enjoyable holiday on one of our vessels and the information
& conditions below will help both you & Charterlink to achieve
this.
PLEASE read the following information. CharterLink Yacht Charters Marlborough endeavours to provide excellent service, a well-maintained fleet and to abide by all legal requirements of Maritime New Zealand, Occupational Health & Safety, and Environmental & local bylaws so all can enjoy a safe "Great Boating Holiday" in the Marlborough Sounds.
BOOKING APPLICATION FORM
- A Booking Application form must be completed for all ‘bareboat’ Charters & pdf or manual form signed showing experience, qualifications (if any) etc.
DEPOSIT
- 1/3 of the Charter/Hire Fee is required with booking application. Confirmation & receipt of booking will be advised in writing.
BALANCE
- The balance of the Charter/Hire can be paid by cash or credit card before, on arrival, or if paying by cheque at least 1 week prior.
CHARTER RATES
- Rates are based on a 24 hours period – Charter pick up and return times between 8.30am and 5.30pm. Minimum 2 x 24 hour days. Minimum 5 days 22nd December – 12th January, 3 days 13th January onwards, Spring, Autumn.
SECURITY BOND
- The Security Bond (excess on insurance) can be paid by cash or credit card authorisation before, on your arrival, or if paying by cheque 1 week prior to departure. The security Bond will be processed as soon as possible after the Charter. (If major damage occurs the bond will immediately be taken. Any balance that might be due after repairs etc. will be forwarded, as soon as possible.)
a) Loss or damage to charter vessel or equipment.
b) Cost of re-fuelling the vessel with diesel or petrol.
c) Cleaning of the vessel, if returned in an unreasonable state.
d) Any costs/losses due to vessel not being returned at the scheduled time. (Extenuating weather conditions are exempt, except if you are in the Pelorus Sound and areas beyond Queen Charlotte when re-location charges may apply.)
INSURANCE
- All vessels are fully insured against fire -marine & collision risks-third party liability. If during the charter period damage or loss is caused, the charterer is liable as follows:
a) To the full extent of loss and damage, which in the Insurers opinion is not claimable against the vessel insurers.
b) To pay full excess on vessel insurance policy.
c) To pay full amount of loss or damage should the claim be declined by the Insurance Company for any reason.
d) All equipment supplied is used by the charter party at their own risk.
CLEANING FEE
- The vessel should be returned clean & tidy, everything back in its place, holding tank empty and all sails & ropes stowed in lockers. A cleaning fee will be retained from your Bond if the vessel is not returned in a reasonable state.
BREAKAGE OR LOSSES
- The Charterer/Hirer pays for losses or breakages (including unblocking toilets). These will be deducted from the bond unless this is required for an insurance claim, when they will be charged separately.
(Please note each vessel is completely checked, counted, serviced & cleaned between charters.)
CANCELLATION
- Cancellations 30 days prior to charter commencement, a full refund of deposit will be given, less $200.00 cancellation fee.
- Cancellations less than 30 days from commencement date will forfeit the deposit unless an alternative charter can be arranged, in which case a full refund of deposit will be given, less $100.00 cancellation fee.
- CHARTERLINK MARLBOROUGH reserves the right to cancel or delay a charter in the following circumstances:
a) If the boat booked is unavailable through unforseen circumstances. Charterlink Marlborough reserves the right to substitute an alternative boat without prior notification and at no extra cost. This shall not constitute a breach of contract and does not entitle hirer to a refund.
b) If Charterlink Marlborough at the charter commencement are not satisfied with the ability of the charterers to sail, handle, navigate and respect the charter vessel, or alternatively at any time during the charter period consider the vessel to be in an unsafe location, or if the actions of the charterers are endangering the vessel, its occupants or any third party. Charterlink Marlborough then reserves the right to either provide a professional skipper at the charterer's expense, terminate the charter without refund, or recall the vessel to any mooring or anchorage, which it considers to be secure.
c) Charterlink recommends you avail yourself of cancellation insurance for in the event your charter is cancelled for reasons beyond your control. Charterlink cannot make refunds for cancellations due to inclement weather.
LATE RETURN
- A late return will incur an extra cost unless a delay is caused for safety reasons. If as Charterer you wish to extend your charter, PLEASE call Charterlink Marlborough on Channel 1 to check on availability (there may be a charter straight after yours). If you decide to go around Cape Jackson to Pelorus and beyond and sea conditions prevent you from returning on time re-location charges may apply.
EARLY RETURN
- There are no refunds for early return of charter.
SAFE SHIP MANAGEMENT
- All charter vessels are surveyed as commercial vessels & subject to safety rules & regulations.
- A mandatory Safety Briefing is required prior to all charters - 8.00am -.5.30pm (daylight permitting).
- Vessels should only be operated in daylight hours. THIS MEANS YOU SHOULD NOT MANOUEVRE ANY VESSEL AFTER DARK. (The only exception is for medical or unsafe conditions in which case CLM must be contacted by VHF Radio on Channel 1 or Maritime Radio on Channel 16 prior to any movement)
- The maximum NUMBER OF PEOPLE on board for a Bareboat charter must not exceed the NUMBER OF BERTHS AS PER VESSSEL SURVEY.
- All vessels are surveyed to extended river limits i.e.Picton, Havelock, Nelson & must remain within those limits. The limits may be restricted according to experience of Skipper & amount of time the vessel has been chartered for. NO VESSEL IS ALLOWED THROUGH THE TORY CHANNEL /COOK STRAIT ENTRANCE.
RADIO
In the interests of your safety and Safe Ship Management policy and operations we require you to call on the VHF to record your overnight position, preferably between 4.00 - 5.00pm each day.
Please read onboard manual for procedure.
SAILING EXPERIENCE
- Boating experience is required for all Bareboat Charters & preferably hold a “Coastguard Education” certificate or equivalent – but not essential. (We encourage everyone to take a course, Day Skipper, Boatmaster theory and RYA practical etc.)
- For Vessels 10m or longer a second person with experience is required.
- The minimum age for Bareboat Chartering is 25, UNLESS specifically agreed upon by Charterlink Marlborough.
SAFETY & ENVIRONMENTAL
- Charterers must adhere to current M.A.F. fishing regulations (fishing in marine reserves could result in your fishing equipment and vessel being confiscated and resultant legal proceedings against you.)
- No animals or pets allowed on charter vessels.
- No firearms allowed on charter vessels.
- Smoking is NOT permitted INSIDE any vessel (There are fire restrictions in the Marlborough Sounds).
- All rubbish must be returned to the marina for disposal.
- Alcohol is not to be consumed in excess. It impairs judgment and may lead to an accident or drowning.
- The charter vessel must at all times be under the control of the designated Skipper, who is responsible for the vessel and all crew whilst on charter.
HIRE AGREEMENT
You will be asked to sign an "Agreement to Hire Rental Boat" after your safety briefing.
LOST PROPERTY
We sometimes find items of clothing or personal equipment are left behind on the boats. As it is not always easy to identify the owners of such gear please contact the office 03 573 6591 and arrange its return. (We have limited storage facilities so any items not claimed within 2 months will be disposed of).
TRANSFERS
A direct transfer from Picton -Ferry Terminal, Railway Station or Accommodation to Waikawa Marina is available at the start & finish of your charter 8.00am to 5.30pm, (please note any diversion resulting in extra costs will be charged to Bond). Please confirm 48 hours prior to the start of your charter. Taxi are available for you to hire at all other times. SoundsAir has a shuttle service between Airport and Waikawa Marina for a nominal fee. There are shuttles and taxis available from Blenheim or Havelock and we can supply you with telephone numbers or email addresses so you are able to book and co-ordinate your travel to suit.
Please note we are approximately 4kms from the nearest Supermarket. We suggest you bring your provisions with you or use our provisioning service & send us a typed list at least 3 days (72 hours) prior to charter - we charge 10% for this service. (Late orders may not be accepted)
